These Terms of Service ("Terms") govern your access to and use of Fyrna Ltd's website, applications, and services, including Shard (together, the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

The Service is intended for use by high school students and their parents or guardians. If you are under the age of 18, you may only use the Service with the consent and involvement of a parent or legal guardian who agrees to these Terms on your behalf.

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Please provide accurate information when you sign up and keep it up to date. Notify us at hello@fyrna.io if you suspect any unauthorised use of your account.

3. Subscriptions and billing

The Service is offered on a subscription basis. Subscription prices, billing intervals, and renewal terms are disclosed at the point of purchase. Subscriptions renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period.

Shard uses artificial intelligence to generate lessons, exercises, explanations, and tutor responses. Although we vet and moderate content and ground responses in curriculum material, we cannot guarantee that AI-generated output is always free of errors. You should treat the Service as a learning aid rather than an authoritative source, and we encourage you to flag any inaccuracies you encounter.

6. Intellectual property

The Service, including all software, content, designs, and trademarks, is owned by Fyrna Ltd or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial educational use, subject to these Terms.

You retain ownership of the content you submit to the Service (for example, your written working, notes, and answers). By submitting content, you grant Fyrna a non-exclusive, worldwide, royalty-free licence to host, process, and use it as needed to provide and improve the Service, in accordance with our Privacy Notice.

7. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms or if we reasonably believe doing so is necessary to protect the Service or its users. You may stop using the Service at any time by closing your account.

The Service is provided "as is" and "as available". To the fullest extent permitted by law, Fyrna disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any specific academic outcome.

9. Limitation of liability

To the fullest extent permitted by law, Fyrna will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

10. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over any disputes arising from or relating to these Terms, except where applicable law gives you the right to bring proceedings in your country of residence.

11. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and update the "Last updated" date. Material changes will be communicated through the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
